Judge declines state’s motion to nix QAR suit

Judge declines motion to dismiss lawsuit involving Queen Anne’s Revenge

BEAUFORT — U.S. District Judge Terrence W. Boyle declined a motion Thursday by state attorneys to dismiss a lawsuit against the N.C. Department of Natural and Cultural Resources, the State of North Carolina and Friends of Queen Anne’s Revenge regarding alleged copyright infringement and the constitutionality of a state law regarding property rights.

In addition, Intersal Inc.  filed complaints last week with the N.C.  Ethics Commission against two N.C. Department of Natural and Cultural Resources employees for alleged violations of North Carolina’s conflict of interest and ethics laws, connected to their use of nonprofit corporations to interfere with Intersal’s rights as discoverer of the shipwreck under a 2013 QAR settlement agreement.
